Interesting that this question has again been voted non-pro when there are various types of mutuo, such as simple vs. de bienes fungibles, in different countries e.g. Mexico and Argentina and many ProZ glossary answers are at variance with each other:

'Assuming (as seems likely from the Q as posted) that this is a pro source text targeted at pro readers, I'd use the Latin: "mutuum contract".'

Mutual contract

Mutual contract is a contract binding upon both parties. Each party to a contract is capable of specific performance of the contract against the other. Also, they can claim damages for failure to perform the contract. Any valid contract is a mutual contract, since it is essential that it bind both parties.

Art. 2099.- Mutuo o préstamo de consumo es un contrato en que una de las partes entrega a la otra cierta cantidad de cosas fungibles, con cargo derestituir otras tantas del mismo género y calidad.
