The customs seizures took place despite the fact that neither XXXCompany nor YYYCompany have received any details of the infringement allegations made by ZZZCompany.
It subsequently transpired from the file documents of the Italian Public Prosecutor that the grounds of ZZZCompany’s demand for seizure were stated to be alleged infringements by XXXCompany of Italian patent number EPXXXXX and a second Italian patent, EPZZZZZ (the “Asserted Patents”).
