Думаю, в первом случае речь о Республике (Римской Республике), а во втором - о "государстве" как противоположности неорганизованной жизни, "естественному состоянию общества".

Тем не менее, я думаю, что речь о государственности, пусть и примитивной. А state of nature и есть своеобразный "первобытный строй", когда никакой государственности вовсе не было. Гоббс наверняка имел в виду этот "беспредел" по сравнению с государственностью. В древнем мире государства тоже существовали - взять тех же шумеров или вавилонян, дравидов, евреев, греков или римлян.
