In the rules for applying for a tender for a public contract:

"Déclaration d’infructuosité et déclaration sans suite

La procédure pourra être déclarée infructueuse en cas d’offres irrecevables ou inacceptables.

Il pourra également être décidé de déclarer sans suite cette procédure."

I know that this is a relatively newly-coined term, which is probably why my researches so far have proved...ahem... fruitless! But they do make an important distinction between it and the previous term (see separate question)

Décision d’attribution

Lorsque aucune offre ne lui paraît acceptable, la PRM, sur proposition ou après avis de la Commission d’appel d’offres, peut déclarer l’appel d’offre infructueux (seules les procédures d’appel d’offres peuvent déboucher sur une procédure *infructueuse*).



La PRM peut alors :

soit relancer la procédure,
soit recourir au marché négocié avec mise en concurrence sous réserve de ne pas modifier le cahier des charges initial. Cette procédure implique une publicité sauf si la PRM décide de négocier avec l’ensemble des candidats qui avaient été admis à présenter une offre.

La PRM peut aussi ne pas *donner suite* à un appel d’offres pour des motifs d’intérêt général ;

Dans ce cas, elle doit, si elle veut relancer la procédure, refaire un appel d’offres.

For an open call for tenders, the Tender Board (CAO) expresses its opinion about the selection of applicants, the elimination of non-compliant bids, the selection of the economically most advantageous bid, and the declaration that the call for tenders is *void*

If no tender appears acceptable, the PRM, acting on advice orproposal of the Tender Board, can declare the call for tender void (only calls for tender procedures can lead to a void declaration)

The PRM can then:

Either restart the call for tenders procedure,
Or resort to the negotiated contract procedure with competition, provided the initial specifications are not modified. This procedure involves publication of an announcement, unless the PRM decides to negotiate with all those applicants selected to submit bids.

The PRM may also *terminate* a call for tenders for reasons of general interest.

In this case, the PRM must issue a new call for tenders if it wishes to restart the procedure.

declaring it null and void, with the consequence of having no legal existence after such declaration, in particular no obligations arising from having once been in existence prior to the declarations.

Thanks, Michael! Although I don't doubt that your answer states exactly the legal intent, I believe that this is a special dedicated EU use of the term, and so I'm going with the 'official' translation Julie has found for me

Purely on a deductive basis that seems to be the distinction they are making (sans suite = no offers).

Thanks, Mark! In actual fact,t hat is more the meaning of the other expression, 'infructueux'; this one is used where there have been offers, but they decided not to pursue it.

Best prefix the phrase woth the dec.
Example sentence:

EU tender cancelled. In July 2003, Elkraft System published an EU tender notice for supply of system services to the East Danish power system in 2004. ...

Thanks, Tom! Your suggestions certainly could work well in other circumstances, but in this speific instance, I'm going with the term that Julie's found, which ties in perfectly with my doc.
