French term

patent misappropriation

There are a few references to this term in the US - I'm linking to a US Supreme Court case (see pp 84 & 100). But usually I see it worded as "patent infringement and misappropriation of trade secrets." So this seems to be a direct translation that works, but it isn't widely used...
Note from asker:
Thanks Laura ! Misappropriation is spot on.

misuse of patent(s)

not a specialist, but seems self-evident...?
Note from asker:
It sort of fits the context, but the other answers seem more appropriate. As for self-evident, as Marcus Tullius Cicero said, “If the truth were self-evident, eloquence would be unnecessary.”
Peer comment(s):

agree Mark Nathan : claiming that something came within the scope of a patent when really it didn't?

agree Tony Walters : agreeing with Mark Nathan: misuse in the sense of abuse or improper exercise (of a patent) rather than infringement

agree Conor McAuley : I can now see the point alright, but depends on context

patent infringement / infringement of patent

Are the common terms (that is, if a outside party is responsible for the détournement):

http://www.google.fr/search?hl=fr&q="patent infringement"&me...

http://www.google.fr/search?hl=fr&q="infringement of patent"...

an outside party

More context needed, but I don't see how someone could misuse their own patent, maybe someone could enlighten me if this can be the case?

No offence taken, Scott, cheers!
Note from asker:
Cheers Conor. Infringement is pretty much what I'm after, but misappropriation seems to fit the wording of the text better. I agree, more context would have been helpful, but the subject is a bit sensitive... All the best.
