The fact that out of courtesy towards the Appeals Board and a desire to render him full justice the ESO took part in the internal proceedings does not detract from the validity of this objection to the receivability of the complaint.

UNE STIPULATION CONTRACTUELLE QUI PREVOIT UNE INDEMNITE EN CAS DE "MALADIE", VISE-T-ELLE TOUS LES CAS DE MALADIES OU LES MALADIES DIRECTEMENT IMPUTABLES AU SERVICE ? DANS LE DEUXIEME CAS, L'INTERESSE AURAIT DROIT A L'INDEMNISATION INTEGRALE DU PREJUDICE SUBI ET DE SES CONSEQUENCES DIRECTES, PAR EXEMPLE UNE INVALIDITE. "SANS TRANCHER CETTE QUESTION ET EN ADOPTANT LA DEUXIEME HYPOTHESE POUR FAIRE RESTE DE DROIT A L'INTERESSE", LE TRIBUNAL RETIENT QUE LA MALADIE N'ETAIT PAS LIEE A L'EXERCICE DE SES FONCTIONS.

A CLAUSE IN THE COMPLAINANT'S CONTRACT PROVIDES FOR COMPENSATION IN THE EVENT OF "ILLNESS". IT IS UNCLEAR WHETHER THE TERM APPLIES TO ALL CASES OF ILLNESS OR ONLY TO CASES OF ILLNESS WHICH WERE DUE TO PERFORMANCE OF DUTIES. UNDER THE SECOND INTERPRETATION, THE PERSON CONCERNED WOULD BE ENTITLED TO FULL COMPENSATION FOR THE PREJUDICE SUFFERED AND ITS DIRECT CONSEQUENCES, FOR EXAMPLE DISABILITY. "WITHOUT SETTLING THAT QUESTION, AND ASSUMING IN THE COMPLAINANT'S FAVOUR THAT THE SECOND INTERPRETATION IS CORRECT", THE TRIBUNAL NOTES THAT THE ILLNESS WAS NOT RELATED TO THE PERFORMANCE OF HIS DUTIES.

: The translator translated the expression "faire droit à" instead of "faire reste de droit à". Not entirely the same.

to dispose of the second (or whatever) argument / allegation
Another angle.
The idea seems to be that of looking at everything that might support the party's case but still coming down against him.
Eg
"This Court can easily dispose of the second argument raised by the Plaintiffs in this appeal simply by resorting to well-established principles of contract interpretation."
Her the context seems to indicate that the "concluant" is denying the relevance of the "temoignage", rather than assuming in his opponent's favour that it is pertinent.
