Transfer of contract
Does anyone know the English terms for "Vertragsnehmer" and 'Vertragsübernehmer" in a Vertragsübernahme? This is from an agreement to transfer an agency contract. Transferor and Transferee, maybe? UK English.

(In my experience, the term "transfer" in this context is unidiomatic, and would not be encountered more than 5-10% of the time. Thus I don't consider it wrong, just unidiomatic.)
(Of course, "transferee" in the above answer is 100% wrong. It should be "transferor".)

assignee
An assignment of contract occurs when one party to an existing contract (the "assignor") hands off the contract's obligations and benefits to another party (the "assignee"). Ideally, the assignor wants the assignee to step into his shoes and assume all of his contractual obligations and rights.

However, if we are talking about "Schuldübernehmer" then more fitting is the term "Assumptor":
WHEREAS, Noteholder, Borrower, Guarantor and Inland Diversified Evans Mullins, L.L.C., a Delaware limited liability company ("Assumptor"), have entered into an Assumption Agreement ("Assumption Agreement") whereby the Borrower's liabilities and responsibilities have been assumed by Assumptor

Discussion
"Das englische Recht behandelt die Vertragsübernahme als Fall der Novation, die eine allseitige Zustimmung voraussetzt."
http://hwb-eup2009.mpipriv.de/index.php/Vertragsübernahme
Cf:
https://australianfranchiselaw.wordpress.com/2011/06/16/fran...
This is highly misleading. A "Vertragsnehmer" is the second part to a contract. See also the old KudoZ answer by Steffen, which you've already posted. So I don't understand at all how this veered off track.
Just one example:
"in weiterer Folge kurz Vertragsnehmer genannt, einerseits
https://secure.asfinag.at/vignette/agb.pdf
The point is that the "assignor is an original party to the contract." Conversely, "The assignee is the party that receives the rights and obligations under the contract, but wasn't an original party to the contract."
http://study.com/academy/lesson/parties-in-an-assignment-rig...
However:
"Durch die Leasingübernahme gehen alle Rechte und Pflichten auf den neuen Vertragsnehmer über."
https://www.leasingmarkt.de/cms/information/haeufig-gestellt...
See what I did there? The part in bold makes it clear that someone else is assuming the role of second party to the contract. There can be an "alter" and a "neuer" Vertragsnehmer.
This doesn't square.
See, "Vertragsnehmer" may be "contractor" and "Vertragsgeber" "contractee." However, in franchising, the franchisor is "Franchise-Geber" and the franchisee "Franchise-Nehmer" - the roles have been reversed.
Unless this is a "sub-subcontracting" scenario, which is highly unlikely, there is no way the given answer is correct.
Let me illustrate:
Party A (Franchise-Geber, franchisor) + Party B (Franchise-Nehmer, franchisee) = franchise contract
Party B (franchisee, but assignor) -> transfers rights -> Party C (assignee) -> contract between Party A and Party C
US example:
"To the extent a Franchisor approves a requested transfer, the Franchisor should not seek [...] from the prior Franchisee, or seek any increased fees from the new Franchisee owner of the subject Facility, because the Franchisee sought to transfer its Facility prior to the scheduled termination date of its franchise agreement."
http://www.aahoa.com/advocacy/franchise-relations/points-of-...
https://www.bwlh.de/Muster/Franchisevertrag/franchisevertrag...
See parts in bold and compare with:
"Area develpment [sic!] agents (also called master franchisees) then function as a ‘sub-franchisor’ and split the roles and responsibilities as well as the franchise fees and ongoing royalties with the franchisor."
http://www.fransmart.com/area-development-franchise/
The point seems to be that you can "subcontract" to save costs.
The "Vertragsübernehmer" is the one who "übernimmt den Vertrag," e.g.:
"Der Vertragsübernehmer übernimmt die gesamte vertragliche Rechtsstellung, ohne dass dadurch der Inhalt oder die rechtliche Identität des bisherigen Schuldverhältnisses verändert werden würde."

The answer you selected is - to use the answerer's own words - "100% wrong." What's even more odd is that it's all right there in the first link he posted:
"An assignment of contract occurs when one party to an existing contract (the 'assignor') (note: that is "Vertragsnehmer" here!) hands off the contract's obligations and benefits to another party (the "assignee") (note: "Vertragsübernehmer"). Ideally, the assignor wants the assignee to step into his shoes and assume all of his contractual obligations and rights."
I've read this to see whether there's any other interpretation:
http://www.franchiseknowhow.com/operations/developmentagents...
But I don't see one.
