Se a tradução for para o inglês americano, sugiro traduzir "primeiro grau" por "district court" ou "trial court". Aqui não é comum dizer "first instance", "second instance", etc. Nunca ouvi isso em relação ao sistema judiciário daqui, embora não esteja errado. É um daqueles termos que o "average American" não vai saber do que se trata.

Inseri as traduções neste contexto para ficar mais claro:
