: I understand what you mean (make the same case for) but isn't this ambiguous in the sense that the case (legal proceedings) is in appeal so they are looking at the same case !!!

2. väsentligen samma utredning: This is the most interesting one IMO: the courts are considering *evidence* or a *body of evidence* or a *report* that is the result of a process of *investigation* or *inquiry*. So there is a metonymic relation between utredning as process and utredning as data.
I'm told that the official English translation of SOU or Statlig utredning is *government official report*, even when referring to an ongoing process.
