Good morning. I am translating a request for . The text quotes 'Section 329 Acquisition, use and possession' of the Money Laundering - Proceeds of Crime Act 2002 saying 'For the purpose of this section [...] the provision by a person of goods or services which he knows or suspects may help another to carry out criminal conduct is not consideration'. I am not sure how to translate 'it is not consideration'. I understand the concept of 'adequate consideration', but I am not sure it applies here. Thanks for your help.

Nota Bene: Sia nel paragrafo (2) - (c):
“he acquired or used or had possession of the property for *adequate* consideration;”
che nei paragrafi (3) (a) e (3) (b):
“a person acquires property for *inadequate* consideration if the value of the consideration is significantly less than the value of the property;”
“a person uses or has possession of property for *inadequate* consideration if the value of the consideration is significantly less than the value of the use or possession;”
si parla di *adequate/inadequate* consideration, mentre nel paragrafo (3) (c) il riferimento è alla sola *consideration*, indipendentemente dall’adeguatezza/inadeguatezza di essa (il motivo del maggior rigore è dovuto al fatto che i beni dati in cambio sono potenzialmente utili a commettere un crimine)

Deve dirsi che "non si considera" un corrispettivo ai fini della disposizione in esame (ossia della scriminante), perché nella realtà dei fatti è senz'altro un corrispettivo, che può in ipotesi essere anche "adeguato".
