This is the core of a case, providing the legal theory which connects the accused to the crimes charged. The ICC Statute provides a general framework for determining individual criminal responsibility. However, the approach taken to individual criminal responsibility differed greatly from that of previous international tribunals. As well the elements of each mode of liability have evolved through case law with various ICC Pre-Trial and Trial Chambers interpreting the diverse elements differently. The Appeals Chamber in the Lubanga case has issued the only decision thus far that deals with Article 25 at the appeals level, essentially confirming the approach taken at the Pre-Trial and Trial level of the case. Continued jurisprudence from the Appeals Chamber will assist in providing certainty moving forward and ending superfluous litigation over diverse opinions at the pre-trial and trial level.
Compared with the previous laws on individual criminal responsibility, the provisions contained within the ICC Statute mark a turning point in regulating modes of participation under international criminal law. The ad hoc tribunals were in their early years during the drafting and adopting of the ICC Statute in 1998, and the modes of liability were a key focus of the development of the ad hoc jurisprudence during this time. In particular, and in contrast to the ICC, the ad hoc tribunals developed their modes of liability in the absence of guidance from their Statutes. Central to this was the concept of joint criminal enterprise, and the extent to which this concept falls within the ICC Statute is debatable.
The ICC Statute is much more precise than the ICTY-ICTR Statutes in that it adopts a scheme that clearly differentiates between a four-tiered system of participation. In contrast to both the ILC Draft Codes of Crimes against the Peace and Security of Mankind and the Statutes of the ad hoc tribunals, paragraph 3 differentiates between perpetration and other forms of participation. The distinguishing criterion is the concept of ‘control over the crime’.[1] Accordingly, the perpetrators exert control over the commission of the crime, while accessories do not possess such a degree of domination over the commission. In particular, perpetration corresponds to the most serious qualification of individual criminal responsibility and it is expressly provided for under letter (a) in three different forms: (i) as an individual; (ii) jointly with another person (co-perpetration) and (iii) through another person (indirect perpetration). Based on the new drafting of the ICC Statute a new format of perpetration has emerged at the ICC based on the notion of ‘indirect perpetration’. Pursuant to this new interpretation, commission of crimes encompasses the concept of ‘control over the crime’, including control over an organized apparatus of power, whereby indirect perpetration interacts with co-perpetration in such a way that the two forms of participation complement each other. This new doctrine on perpetration serves to make clearer the distinction between principal and accessorial liabilities within the context of the collective and multi-level commission of crimes. The Pre-Trial Chamber of the ICC has taken this all one step further in a decision in the Katanga and Ngudjolo case, where the judges decided that the ‘control over the crime’ amounted to ‘control over the organization’.[2] Now, the requirements of indirect perpetration include the existence of an organized apparatus of power, within which the direct and indirect perpetrators operate, and which enables the indirect perpetrator to secure the commission of the crimes (Katanga and Ngudjolo, 30 September 2008, paras. 515-518).

And the brain was also the part of your body that made the decision to read this article in the first place. In different animals, brains are very different. There are large and small brains, smooth and wrinkled brains, brains with some parts larger than others. How are these brains built? How did they come to be so different from each other—and why does that matter?
ANIMALS SHARE AN EVOLUTIONARY HISTORY
Not only humans have brains, of course. Almost all animals have a nervous system of some kind (only sponges do not). The brains of different animals are different in some ways but similar in many other ways. This is because all life on the planet shares a history: all animals evolved from common ancestors, so they inherited some of the characteristics from these ancestors. This is like a brother and a sister who are alike because they have the same parents, first cousins who have the same grandparents, second cousins who share great grandparents, and so on. All life shares a great-great-great-grandparent in the distant past. We can use these similarities and differences between animals to put the animals together into groups. Two birds—say, an eagle and a parrot—have more in common than an eagle and a monkey. And they are closer relatives. In a family, this would be like saying that a brother is more like his sister than he is like his cousin. A brother and a sister have the same parents, but with their cousin they only share the same grandparents, further back. Still, all mammals have fur and produce milk to feed their young. Every bird has feathers and lays eggs. And these similarities between close relatives appear in their brains, too. Each species has their different habits: a monkey jumps from branch to branch until it finds some fruit to eat, a bat flies around in the dark of the night between trees, a whale swims in the wide open ocean. Since the brains of these animals help them to do all these tasks, we would guess that their brains would be very different. But it turns out that the main parts of the brain and the connections within the brain are all pretty much the same for all mammals. This similarity in brain structure exists because of the evolutionary history that all these brains share. In fact, if we put brains of different mammals next to each other, the similarities are easy to spot. Even though the brains vary (a lot) in their size and in their folds, they all have the same parts. All these brains have a cerebral cortex, a cerebellum, and a brain stem (see Figure 1B). Also, the same kinds of cells make up all brains: they are made of neurons, glial cells, and the cells that make the capillaries (small blood vessels) that bring blood into the brain (Figure 1A). Neurons transmit information to other neurons through their branches, across connections called synapses. Glial cells are of three kinds. Microglia are the immune system in the brain. Oligodendrocytes wrap the branches of the neurons and make information move faster from one neuron to the next. Astrocytes do a lot of things, keeping everything in order—from helping neurons make synapses to providing them with nutrients.

The museum industry has witnessed significant growth in the last two decades, with the number of museums increasing from around 23,000 two decades ago to more than 55,000 by 2012 . Aesthetically designed museums covering a wide variety of subjects (arts, science and history) coupled with increasing education levels of visitors has renewed visitor interest and attendance, and museums now function as major tourist attractions.
The attendance at the top 20 museums worldwide was recorded at approximately 107 million visitors in 2014, a 1.6% increase on 2013 attendance figures. Each of the top 10 ‘blockbuster museums’ shown in Exhibit 1 attracted in excess of 5 million visitors in 2014, with the Louvre topping the list with more than 9 million visitors.
Economic Impact of Museums
While the primary objective of a museum remains conserving a collection of artifacts with artistic, cultural, historical or scientific importance and showcasing it to the public, the economic impact associated with museums can be quite significant. The direct and indirect economic activity generated from international visitors of museums is categorized in Exhibit 3.
In the UK for example, where well established museums and galleries are among the most popular visitor attractions, the economic activity generated by museums can be a significant source of revenue. In addition, museums and also help develop the country’s brand. In 2009, VisitBritain (UK’s national tourism agency) estimated its museums and arts galleries had secured US$ 1.4 billion of inbound visitor spending. The agency estimates that 48% of international holiday visits within England and 55% in London include a visit to a museum . In addition, the number of overseas museum visitors have almost doubled over the past decade, with the UK receiving over 21 million overseas visitors in 2013-14 . The agency believes museums are a key strength for the UK’s international brand and a motivator to visit .
Guggenheim Museum Bilbao is another example where significant economic benefits can be directly attributed to new museum development projects. The museum was started in October 1997 and was able to attract 1.3 million people within its first year of operation. The revenue generated within its first year was sufficient to recover the museum’s construction costs. By 2001, the Bilbao Deputy Mayor assessed that the museum in its four years since opening had already generated approximately US$ 550 million of economic activity for the city .
Foreign Collaboration in Museum Developments
New museum developments in emerging countries are increasingly being developed with foreign collaboration from established and reputed museums. There are two broad approaches in which foreign collaboration is sought when setting up a new museum. The first and more common approach is for reputed museums to leverage their experience in museum development and management by offering consulting services to foreign countries when setting up a new museum. The nature of these consulting services can range from issues related to design, construction, and museography to educational and curatorial services to training of the museum staff. An example of this approach is the Zayed National Museum (UAE) and King Abdulaziz Centre for World Culture (Saudi Arabia), both of whom enlisted various consulting services from the British Museum in UK.
The second approach can be considered as a form of museum franchising. In this model a reputed museum offers its brand name to a new museum being set-up in a foreign country. In addition to the brand name the reputed museum also provides consulting and operation management services. The Solomon R. Guggenheim Foundation (SRGF) owners of the Guggenheim Museum New York (NY) have been the pioneer of the museum franchising approach and its Guggenheim Bilbao (Spain) museum is counted among the most successful examples to date.
In 1991, the local Bilbao government (Basque Administration) and SRGF decided to build The Guggenheim Bilbao Museum. As per the agreement, the local Bilbao authorities would finance the project and pay SRGF an upfront fee of US$ 20 million for their brand name. Under the contract SRGF would retain the overall museum management responsibility and provide curatorial and administrative services for which they would separately charge for .
Risks and Challenges in Museum Planning, Design and Construction
While the artifacts showcased are the major focus of the visitors, the iconic and unique building designs of the museum are an important factor in drawing tourists. Attaching the name of a ‘starchitect’ to a new museum serves as a way to generate greater excitement around the completion of a building. Given the unique design and complexity associated with museum development projects, construction timelines range anywhere between two and twenty years and are faced with significant execution challenges and risks. Typical project phases include initial planning and architectural design, fund raising, construction and finally the museum opening.
A critical factor in developing these unique building designs is strong co-ordination between the design and construction teams. An example of the strong coordination between design and construction can be witnessed in the development of the Guggenheim Bilbao Museum. In this situation, Frank Gehry and Associates (FOGA) were selected as the design architects of the museum. The next step was to select the construction manager who would be responsible for bringing FOGA’s designs to reality. Given the need for strong co-ordination between the design architects and the construction manager, FOGA was included in the process of selecting the construction manager. The construction manager (IDOM, a local construction management firm) had two architectural responsibilities in addition to its core construction management role. The first architectural responsibility was to respect the aesthetics of FOGA’s designs and to interpret it correctly on the site. The second responsibility was to make the construction of the architecture possible in Bilbao (Spain) leveraging its local knowledge. This meant that before FOGA designs were incorporated in the construction drawings for bidding, IDOM studied them to check if it was possible to be done easily in Spain and if that would not be possible, IDOM was to suggest changes to FOGA that would not alter the appearance of the building.
The other critical aspect during the construction phase of museums is strong project management capabilities. Even with contractors experienced in building museums there are often unanticipated challenges that arise given the one-of-a-kind designs and local issues which result in change orders. In addition to this, there are thousands of workers across multiple subcontractors, suppliers and consultants all working simultaneously. Organizing and managing subcontractors and suppliers requires a dedicated and highly experienced project management team which is vital to the success of such a project.

TDIC was established by law no. 12 in 2005. The company is mandated to manage tourism investment zones and support the Abu Dhabi Tourism & Cultural Authority (TCA) in serving as the master developer of major tourism cultural and residential destinations.
Currently, TDIC is developing the Saadiyat Cultural District area. This program consists of three museums: the Louvre Abu Dhabi, Zayed National Museum, and Guggenheim Abu Dhabi. Louvre Abu Dhabi is the first of three museums to be constructed.
The Louvre Museum
The project was approved after signing of an intergovernmental agreement between the UAE and France in 2007. The agreement included partnership with the Louvre and fifteen other museums in France. Following that governmental agreement, the (AFM) was created to represent the French government during the design and construction of Louvre Abu Dhabi.
In 2010, the Executive Council instructed TDIC to put the project on hold. Subsequently, approval was provided to TDIC to award the main contractor during 2012. A timeline for the development of Louvre Abu Dhabi is shown in Exhibit 1.
1. Abu Dhabi Tourism and Culture Authority (TCA)
TCA is ultimately the owner of the Louvre museum and the Authority is heavily involved in interaction with AFM. The role of TCA in the project is as follows:
• Handling AFM requirements on project specifications
• Collecting and securing art works
• Playing oversight role on the project performance
• Operating the museum
2. Agence France-Museum (AFM)
Roles and responsibilities of the agency are as follow:
• To facilitate between the different museums in France and the project
• To provide recommendations on best practices in the industry
• To support project execution and project delivery

3. Tourism Development and Investment Company (TDIC)
TDIC is responsible for managing the design and construction of the museum. After the construction phase is completed, assets will be handed over to TCA for operations. The number of TDIC staff involved in providing management of the Louvre Abu Dhabi project is shown in Exhibit 2.
