Testo originale - Italiano 24. نود الإفادة بأن مشروع اللجنة الوطنية للطفولة الخاص بتدارس الأنظمة والتشريعات الوطنية ومدى تطابقها مع بنود الاتفاقية الدولية لحقوق الطفل يعد مشروعاً مستمراً يسعى إلى تحليل تلك الأنظمة والتشريعات بغية مُواءَمَتها مع مبادئ وبنود الاتفاقية. كما تجدر الإشارة إلى أن المملكة الآن تشهد مرحلة تطور نوعي شامل في مجال القضاء والتشريع على وجه العموم وما يتصل منه بالأطفال على وجه الخصوص. وقد قامت المملكة بسلسلة من التعديلات والإصلاحات القضائية والتشريعية٬ نورد هنا ما يبين سعي الدولة وجهودها نحو مُواءَمَة أنظمتها الوطنية مع مبادئ وبنود الاتفاقية التي سيأتي ذكرها في هذا التقرير٬ وذلك على النحو الآتي:
1 إطلاق مشروع الملك عبدالله لتطوير القضاء, وصدور نظامي القضاء وديوان المظالم وآليتهما التنفيذية بالمرسوم الملكي رقم )م/78 ( وتاريخ 19/9/1428هـ )30/9/2007م(٬. وقد اعتمد مبلغ وقدره سبعة مليارات ریال لتنفيذ مشروع التطوير. ويستهدف المشروع إعادة هيكلة مؤسسات القضاء؛ لتؤدي واجباتها بفعالية تكفل الحقوق للمواطنين والمقيمين٬ وذلك عبر تطوير الأداء في وزارة العدل٬ ورفع كفاءة الكوادر القضائية من قضاة وكتاب عدل وإداريين٬ وتوفير الوظائف والتجهيزات الفنية والتقنية٬ وتطوير مباني المحاكم. ويتضمن المشروع تطوير الهياكل التنظيمية لجهازي القضاء والتوثيق٬ وتعزيز وظائف العدل الوقائي٬ ومركز الأبحاث القضائية٬ ودراسة الإجراءات والنظم الإدارية الحالية وتقويمها٬ وإعادة هندستها٬ وتعزيز متطلبات الثقافة العدلية لدى منسوبي مرفق القضاء والتوثيق٬ وتأسيس مكاتب نسائية في المحاكم الشرعية٬ وغيرها؛ لاستقبال النساء٬ وإنهاء إجراءات شؤونهن بيُسر.
2 صدور المرسوم الملكي رقم )م/51( وبتاريخ 23/8/1426هـ٬ )27/9/2005م( بالموافقة على نظام العمل الذي يتضمن منع تشغيل أي شخص لم يتم الخامسة عشرة من عمره٬ ومنع دخوله أماكن العمل. 3 صدور قرار مجلس الوزراء رقم 139 وبتاريخ 26/4/1425هـ ٬ بأن يكون التعليم إلزامياً لمن هم في سن السادسة إلى الخامسة عشرة٬ وآليات التنفيذ؛ لضمان تفعيله. 4 صدور نظام الهيئة العامة للولاية على أموال القاصرين ومن في حكمهم بالمرسوم الملكي ذي الرقم م/17 وبتاريخ 13/3/1427هـ )12/4/2006م( المبني على قرار مجلس الوزراء ذي الرقم 53 وبتاريخ 12/3/1427هـ )11/3/2006م(. ويتكون هذا النظام من )41( مادة مقسمة على تسعة فصول٬ تستهدف ضمان أموال القصر والحمل الذين لا ولي أو وصي لهم٬ وإدارة أموالهم٬ وكذلك الإشراف على تصرفات الأوصياء والقيمين والأولياء. 5 صدور قرار مجلس الوزراء رقم )169( وبتاريخ 19/6/1429هـ٬ )23/6/2008م( بالموافقة على الضوابط الجديدة المنظمة؛ لإيداع الأحداث في دور الملاحظة الاجتماعية. 6 صدور نظام القضاء بالمرسوم الملكي ذي الرقم م/78 وبتاريخ 19/9/1428هـ )1/10/2007م( والذي يتضمن ضمان العدالة للحدث عبر النص في النظام على إنشاء دوائر لقضايا الأحداث في المحاكم الجزائية٬ حيث تتشكل كل دائرة من قاض فرد أو ثلاثة قضاة٬ وهذا يعد ُّ تطوراً مهماً نحو تحقيق ضمانات المحاكمة العادلة والملائمة للحدث٬ حيث كانت المملكة تعتمد قبل صدور هذا النظام على نظام القضاء الفردي في قضايا الأحداث. 7 صدور قرار مجلس الوزراء رقم 366 وبتاريخ 3/12/1429هـ )2/12/2008م( متضمناً جملة من التعليمات التي من شأنها اتخاذ ما يلزم؛ للحدّ من مشكلة العنف الأسري. 8 صدور المرسوم الملكي الرقم: م/ 40 وبتاريخ: 21/7/1430هـ )14/7/2009م(٬ بالموافقة على نظام مكافحة جرائم الاتجار بالأشخاص٬ وموافقة مجلس الوزراء السعودي في شهر رجـب 1430 هـ )يوليو 2009م( على تشكيل لجنة؛ لمكافحة جرائم الاتجار بالأشخاص. 9 موافقة مجلس الشورى على مشروع نظام حماية الطفل بالقرار رقم 145/74 وبتاريخ 13/2/1432هـ٬ )12/8/2011م( ٬ حيث رفع من اللجنة الوطنية للطفولة كأحد إجراءات مواءمة الأنظمة الوطنية مع اتفاقية حقوق الطفل. ويعد النظام مكسباً كبيراً لحقوق الطفل٬ ونقلة نوعية في نظرة المجتمع إلى موضوع حماية الأطفال. وتقوم عدة جهات في الوقت الحاضر بتدارس آليات وإجراءات تنفيذ بنود النظام. هذا وتجدر الإشارة إلى الموافقة على نظام الحماية من الايذاء الصادر بالمروسوم الملكي رقم )م/52( وتاريخ 15/11/1434هـ, والذي يشمل الطفل والمرأة٬ وسيسهم هذا النظام )مع نظام حماية الطفل( في تأسيس منظومة تشريعية شاملة في حماية الطفل والمرأة من جميع أشكال الإساءة إليهما. 10 تعديل نظام الجنسية بموجب المرسوم الملكي رقم م/54 وبتاريخ 29/10/1425هـ )17/7/2004م( ٬ وصدور اللائحة التنفيذية المعدلة لنظام الجنسية. كما صدر في شهر يناير من عام )2012م( التعديل على المادتين 7 و 21 بشأن ضم الإناث وشمولهن بقرار تجنيس أبناء السعوديات المتزوجات من غير السعوديين؛ ليشمل النظام الذكور والإناث على حد سواء. 11 موافقة مجلس الشورى بقراره رقم )170/71( وتاريخ 25/1/1434هـ على مشروع نظام الوقاية من متلازمة العوز المناعي المتكسب )الإيدز( وحقوق المصابين وواجباتهم٬ ومن ضمن مواده مجانية العلاج لجميع المصابين٬ والمصابات ووضع إجراءات وسياسات تضمن حماية الأطفال من الاصابة بالفيروس٬ مثل: فحص جميع الحوامل؛ لمنع انتشار المرض منهن إلى الجنين. 12 يدرس حالياً في مجلس الوزراء مشروع نظام لرعاية الأحداث بالاشتراك مع الجهات ذات العلاقة.
Traduzione - Inglese 24. We would like to report that the project for the Special National Committee on Childhood is examining national legislation and regulations and their conformity with the terms of the International Convention on the Rights of the Child. This is an ongoing project, which seeks to analyse legislation and regulations in order to align them with the principles and provisions of the Convention. It should also be noted that the KSA is currently undertaking a general comprehensive qualitative development in the judicial and legislative sectors, with particular focus on how they relate to children. KSA has implemented a series of amendments and judicial and legal reforms. Here we report on [measures] which illustrate the state’s efforts toward harmonising national regulations with the principles and provisions of the Convention as follows:
2 – Royal Decree no. (m/51) dated 23/8/1426 (27 Sept 2005): A resolution on the labour code including a ban on the employment of any individual under the age of 15, and a ban on under 15s entering the workplace.
3 – Council of Ministers Resolution no. 139 dated 26/04/1425, stipulating that education is compulsory for children between the ages of 6-15, and setting up mechanisms to ensure the law is enacted.
5 – Council of Ministers Resolution no. 169 dated 19/06/1429 (23 June 2008), approving new organisational controls for the placement of juveniles in Homes of Social Observation.
6 - The issue of the justice system by Royal Decree no. m/78 dated 19/9/1428 (1 Oct 2007), which includes a guarantee of justice for juveniles through the letter of the law on setting up departments for juvenile cases in criminal courts, whereby each department is made up of between one and three judges. This is a significant development towards realising assurances of appropriate and fair trials for juveniles, for which the KSA, prior to the enactment of this law, relied on individual judgment [discretion of judges] for juvenile cases.
9 – The Agreement of the Shura Council regarding the bill of law on the Protection of the Child with resolution no. 145/74 dated 13/2/1432 (12 August 2011), which has been submitted by the National Committee for Childhood as one of the steps to harmonise national codes with the Convention on the Rights of the Child. The law is considered a huge step and a paradigm shift in the public’s perception of the issue of child protection. Several entities are currently examining the mechanisms and procedures for implementing the law’s provisions. Furthermore, it is worth highlighting the agreement on the law for the protection from abuse issued by royal degree no. (m/52) dated 15/11/1434, which includes [protection of] women and children. This law will contribute, (along with the law for the protection of children), to a comprehensive legislative system for the protection of children and women from all forms of abuse/harm.

تساءلت اللجنة الدولية لحقوق الطفل في الفقرتين رقم 32 وَ 33 من تقريرها الصادر عقب النظر في التقرير الدوري الثاني للمملكة حول توقيع عقوبة القتل على الأطفال الذين يرتكبون جريمة٬ ومدى الحرية المتاحة للقضاة في تقدير بلوغ سن الرشد حين ينظرون في القضايا الجنائية التي تشمل أطفالا٬ً وأوصت بحظر عقوبة القتل على جميع الأشخاص لارتكابهم جريمة قبل بلوغهم سن 18 عاماً. كما تساءلت في الفقرتين رقم 34 وَ 35 من تقريرها الختامي٬ حول اندلاع الحريق في المدرسة المتوسطة للبنات في مكة عام )2002م( ٬ وتوصيتها باتخاذ جميع الإجراءات الضرورية لضمان أن تكون جميع المباني المدرسية والمؤسسات الأخرى آمنة للأطفال.
وبناء عليه٬ تكفل الأنظمة المعمول بها في المملكة العربية السعودية الحق في الحياة والبقاء والنمو على أرضها لجميع الأطفال دون تمييز٬ مع توجيه عناية خاصة للأطفال الأكثر احتياجاً بغض النظر عن الجنس أو اللون أو العرق أو المعتقد٬ مثل: الأطفال الأيتام٬ والمعوقين٬ والأطفال مجهولي الأبوين٬ والأطفال الذين يولدون خارج نطاق الزوجية٬ والأطفال الذين يحرمون من رعاية الوالدين أو أحدهما أو الأقارب بسبب الوفاة٬ أو الانفصال بين الزوجين٬ أو لمرض الأم٬ أو لأي سبب آخر. ويتم توجيه هذه العناية عبر التشريعات والنظم والمؤسسات الإيوائية والأسر البديلة التي تم وصفها في تقرير المملكة الثاني٬ والتي تشرف عليها وزارة العمل والشؤون الاجتماعية ومشاركة عدة جهات أهلية وحكومية عبر مؤسساتها المختلفة المنتشرة في مناطق المملكة حيث يلقى الأطفال رعاية اجتماعية٬ وصحية٬ وتعليمية٬ وتربوية٬ ونفسية٬ ومهنية٬ إضافة إلى توفير جو الأسرة البديلة بإيوائهم وإطعامهم وكسوتهم وفيما يحقق رفاهيتهم٬ بما في ذلك صرف المكافآت الشهرية لهم٬ وتمكينهم من ممارسة هواياتهم وتعلم بعض المهن المفيدة ليكونوا أعضاء فاعلين في المجتمع. ومن أهم هذه البرامج على سبيل المثال دور التربية الاجتماعية٬ ومؤسسات التربية النموذجية٬ ودور رعاية الأيتام٬ ودور الملاحظة الاجتماعية٬ ودور الرعاية المؤقتة٬ ودور الضيافة لذوي الظروف الخاصة٬ وبرامج تأهيل المعوقين مهنياً واجتماعياً وصحيا٬ً وبرامج رعاية الأطفال المشلولين٬ والرعاية النهارية٬ وبرنامج الأسر البديلة وفق نظام الكفالة٬ وبرامج الجمعيات الخيرية التي تحقق مشاركة المجتمع في رعاية الأطفال سواء أكانوا من العاديين أم غير العاديين عبر الجمعيات الخيرية ومراكز الخدمة والتنمية الاجتماعية التي بلغ عددها 671 جمعية خيرية بالمملكة )يرجى النظر في فقرات 122 إلى 137(. ويجدر التنويه في هذا التقرير إلى قيام الدولة بجهود حثيثة في مجال زيادة عدد هذه المؤسسات والبرامج وتوسيع انتشارها والرفع من كفاءة كوادرها ومخصصاتها المالية في السنوات الأخيرة على نحو تم تفصيلها سابقا في هذا التقرير. وبالنسبة إلى عقوبة القتل٬ فإن المملكة اتخذت خطوات جادة في هذا المجال عبر نظام الأحداث الذي سيتم تفصيله لاحقا٬ً مع التركيز على التدابير القضائية والبرامج الخاصة في هذا المجال٬ وتعمل هيئة التحقيق والادعاء العام على متابعة وتقصي ظروف الأحداث ومراعاة الحقوق الإنسانية في تطبيق الإجراءات العقابية المختلفة٬ حيث لا يجوز معاقبة الأحداث بأي نظام سوى الأنظمة الخاصة بهم والمطبقة عليهم. ونظراً لتشابه وتقاطع ملحوظات وتوصيات اللجنة الدولية المذكورة هنا مع تلك التي تم معالجتها في صدد ملحوظات وتوصيات اللجنة حيال المراجعة الدورية لإيداع الطفل في المؤسسات )المادة 25(٬ وتقاطعها كذلك مع تناول ملحوظات وتوصيات اللجنة الدولية لحقوق الطفل بشأن نظام عدالة الأحداث )المواد 37 و39 و40(٬ فيرجى النظر في فقرات رقم )161 إلى 167(٬ و فقرات رقم )316 إلى 322(.
وبشان تساؤل اللجنة الدولية في الفقرة رقم 34 حيال اندلاع الحريق في المدرسة في مكة عام )2002م(٬ نود الإفادة بأن المملكة اتخذت إجراءات جادة وسريعة على نحو يستيجيب لتوصية اللجنة الدولية في وقاية جميع الأطفال من مثل هذه الحوادث المؤلمة٬ وضمان أن تكون جميع المباني المدرسية والمؤسسات الأخرى آمنة للأطفال عبر توظيف الإجراءات والتدابير الآتية:
1 كخطوة جادة في المحافظة على أمن وسلامة الأطفال٬ تم حديثاً إنشاء الإدارة العامة للأمن والسلامة المدرسية في جهاز الوزارة بقرار سمو الوزير رقم 33955837 بتاريخ 2/6/1433هـ )25/4/2012م(٬ كما أنشئت بموجب القرار إدارات للأمن والسلامة في كل إدارة تربية وتعليم. وتختص الإدارة ببناء وتنفيذ الخطط السنوية والإستراتيجية للأمن والسلامة المدرسية والإشراف على عمليات الإخلاء٬ وتمارين الإطفاء والإنقاذ الدورية٬ وتطوير ومتابعة تطبيق اللوائح والتعليمات التي تحدد شروط وقواعد الأمن والسلامة الواجب توافرها في المدارس بما يضمن توفير بيئة آمنة لهم.
2 وشرعت هذه الإدارة المستحدثة في تطوير معايير بيئية؛ لضمان الأمن والسلامة في المدرسة٬ ووضعت أدوات محكمة؛ لقياس هذه المعايير بما لا يقل عن مرتين كل عام٬ كما حددت إجراءات التعامل مع أي مخاطر موجودة في المدرسة. وتنفذ الإدارة حالياً برامج تدريب لكل من العاملين والطلاب في تنفيذ إجراءات الأمن والسلامة في المدرسة٬ وفعاليات؛ لنشر الوعي والتثقيف بين الأطفال في مجالات الأمن والسلامة.
3 وضمن مشروع وزارة التربية في تطوير البيئة المدرسية وضمان سلامتها٬ سخرت الوزارة جُل طاقاتها المالية والبشرية نحو إنشاء وتشييد مبان مدرسية تتوافق مع معايير الأمن والسلامة)يرجى النظر في فقرة رقم 245(. 4 تخصيص وحدة دراسية في مواد الدراسات الاجتماعية والوطنية لجميع الصفوف الدراسية عن )السلامة( وتشتمل تعريفاً عن إجراءات السلامة وأساليب التصرف في حالات الخطر الشائعة٬ مثل: )السيول/الحرائق(٬ وعادة ما يستعين المعلمون برجال الدفاع المدني في إجراء دروس تطبيقية عن السلامة٬ كما يتم وبشكل مستمر بالتعاون مع هيئة الهلال الأحمر السعودي٬ ووزارة الصحة على تقديم برامج تدريبية للطلاب والطالبات والمعلمين والمعلمات في مجال الإسعافات الأولية.
5 وفي الإطار نفسه٬ وبعد دراسة مستفيضة؛ للتأكد من إمكانية تطبيق برنامج السلامة من الحرائق داخل المدارس٬ أطلقت أرامكو السعودية بالتعاون مع وزارة التربية والتعليم في يوم )12/3/2012م( المرحلة الأولى من حملة

الوقاية من الحريق في المدارس تحت عنوان )معاً لمدارس خالية من الحريق(٬ وتهدف إلى حماية وتثقيف الطلاب على مستوى المملكة من أخطار الحريق في المدارس٬ والحد من حدوثه٬ وأفضل الطرق والممارسات؛ للتعامل مع الحريق في حال نشوبه٬ وستغطي الحملة نحو )2200( مدرسة على مستوى المملكة يتم خلالها التدريب على عمليات الإخلاء في حالات الحريق٬ وتقديم مواد تثقيفية للمعلمين والطلبة على حد سواء. وتتضمن الحملة برنامجاً تحت مسمى )درب المدرب(٬ وهو يعنى بتأهيل المعلمين والمعلمات٬ بالإضافة إلى مجموعة كبيرة من المتطوعين؛ لمواصلة الحملة لكي تشمل بقية مدارس المملكة التي لم تدرج في المرحلة الأولى. ويذكر أن الحملة في مرحلتها الأولى أعطت الأولوية للمدارس في قطاع تعليم البنات حيث استفاد منها )29.677( طالبة و )794( معلمة و )11.111( ولي أمر٬ و )81( مدرسة ابتدائية ومتوسطة وثانوية. وفي قطاع البنين٬ تم تدريب )147 ألف( طالب و )14500( معلم في )600( مدرسة. وما زال العمل متواصلاً في الحملة؛ لتحقيق أهدافها٬ واستهداف باقي المدارس في المملكة.
6 كما تم بالتنسيق بين وزارة التربية والتعليم مع المديرية العامة للدفاع المدني بمناسبة اليوم العالمي للدفاع المدني في )1/3/2006م( تحت شعار )الدفاع المدني والمدرسة( إطلاق حملة واسعة؛ للتوعية والتثقيف عن إجراءات واحتياطات السلامة في المدارس٬ شملت جميع مدارس المملكة )بنين وبنات( حيث شاركت فروع الدفاع المدني في مدن المملكة بالتنسيق مع الإدارة العامة للنشاط الطلابي في تنظيم العديد من الفعاليات والمعارض والمحاضرات. كما قامت مديرية الدفاع المدني بإصدار سلسلة تثقيفية تستهدف الأطفال بعنوان "الطفل المنقذ" حيث أصدر من السلسة )5( أعداد تم توزيعها على جميع المكتبات المدرسية٬ كما أصدرت سلسلة أفلام بالرسوم المتحركة )الكرتون( تستهدف الأطفال دون سن )12( سنة بعنوان "منقذ"٬ وتم توزيعها على المدارس٬ وفي إطار نفس الحملات التثقيفية والتوعوية تم إعلان شعار "الدفاع المدني ودور الأسرة" للعام )2011م(٬ حيث تم بالتنسيق مع الدفاع المدني تدشين حملة شاملة شملت توعية أولياء الأمور بدورهم في السلامة.
7 كما بادرت وزارة التربية والتعليم إلى إطلاق خدمة )جوال المدرسة( وهي خدمة تتكفّل الوزارة بجميع تكاليفها المادية من حيث دفع رسوم الاشتراك في الخدمة٬ ودفع تكاليف الاتصالات والرسائل٬ وتصرف لكل مدرسة ميزانية خاصة؛ لتغطية تكاليف الخدمة التي تهدف إلى استثمار تقنية الاتصالات الحديثة في تعزيز التواصل مع أولياء الأمور عند الحالات الطارئة عبر خدمة الرسائل القصيرة ٬SMS وذلك بتخصيص خط جوال لكل مدرسة )بنين/بنات(؛ لتسهيل التواصل معهم في الكثير من الحالات التي تستدعي التواصل المباشر٬ ومن بين تلك الحالات التواصل معهم في حالات الخطر المحتمل )السيول/موجات الغبار الشديد/التقلبات الجوية/أي حالات طارئة أخرى(.
Traduzione - Inglese 85. The International Committee for the Rights of the Child (CRC henceforth) enquired in paragraphs 32 and 33 of its report, which was published following consideration of the second periodic report of the KSA on the application of the death penalty to children who have committed crimes. The report also enquired about the extent of freedom available to judges in cases until children reach puberty, when they view cases involving children. The CRC advised banning the death penalty for anyone under the age of 18 who has committed a crime. The CRC also enquired in paragraphs 34 and 35 of its latest report about the fire at the girls middle school in Mecca which occurred in 2002, and recommended that all necessary steps be taken to ensure all educational buildings and facilities be rendered safe for children.
86. Following this, the applicable regulations in KSA [are] the right to life, survival, and growth on its territory for all children irrespective of gender, colour, ethnicity, or beliefs, without discrimination, and with special consideration for children most in need, such as: orphans, the disabled, children of unknown fathers, children born out of wedlock, children neglected by one or both parents, or relatives due to death, their parents’ divorce, or mothers’ illness, or any other reason. This consideration is given through laws, systems, shelters, and foster families which are described in the Kingdom’s second report, and which are overseen by the Ministry of Labour and Social Affairs, and which are shared by a number of civil and governmental stakeholders through their various foundations spread throughout the Kingdom’s regions, whereby children receive social, health, educational, psychological, and vocational care, in addition to providing a substitute family environment with shelter, food, and clothes, and which realise their welfare, including a monthly stipend, and which make it possible for them to pursue their hobbies and education in some beneficial fields to enable them to become active members of society. Among the goals for this programme, for example, are the roles of social education, exemplary educational foundations, caring for orphans, social oversight, temporary care, hosting for those from special circumstances, and programmes for professional, social, and health rehabilitation of the disabled, programmes of care for paraplegic children, day care, and foster family programmes in accordance with the sponsoring system, programmes for charitable groups which help society share in caring for children, whether they be normal or not, through charitable groups, and services and social development centres. There are 671 charitable groups in the Kingdom (see paragraphs 122-137). It should be noted in this report that the state has undertaken great efforts to increase the number of these foundations and programmes, and to make them more widespread, to build their capacities and grow their staff and numbers of finance specialists in recent years, as has been detailed previously in this report.
87. Regarding the death penalty, the Kingdom has taken serious steps in this area through the juvenile system, which is elaborated in the following sections, with a focus on judicial measures and special programmes. The Committee for Investigations and Public Prosecutions works on monitoring and investigating the circumstances of events and observing human rights in the application of different punitive measures, such that minors may not be punished except by special regulations and regulations applicable to minors. In view of the similarities and overlap between observations and recommendations made by the CRC mentioned here, with those which were addressed in the periodic review of treatment of children in care (Article 25), and their overlap with the observations and recommendations of the CRC committee on the rights of the child with regards to the juvenile justice system (Articles 37, 39, and 40), please see paragraphs 161-167 and 316-322.

على النحو الآتي:
162. صدور قرار مجلس الوزراء رقم )169( وبتاريخ 19/6/1429هـ٬ )23/6/2008م(٬ بالموافقة على الضوابط المنظمة لإيداع الأحداث في دور الملاحظة الاجتماعية. وتتركز هذه الضوابط التي تم تفصيلها في فقرة رقم )320( على المعالجة٬ والتأهيل٬ وإعادة دمجهم في المجتمع على نحو يستلهم التوجهات العامة في اتفاقية حقوق الطفل. كما تقوم عدة جهات حكومية بتدارس نظام رعاية الأحداث بغية تجويده ومعالجة جوانب القصور في النظام المعمول به الأن٬ كما يتضمن المشروع إنشاء محاكم للأحداث. وقد قامت اللجنة الوطنية بالطفولة بدراسة ومراجعة مسودة هذا النظام المقترح٬ وإجراء التعديلات المناسبة وفق اتفاقية حقوق الطفل٬ وملحوظات اللجنة الدولية على تقرير المملكة الثاني٬ وتزويد هذه الجهات بالاتفاقية وملحوظات اللجنة الدولية ذات العلاقة بالأحداث؛ لأخذها في الحسبان أثناء صياغة المسودة النهائية لهذا النظام. 163. صدور قرار مجلس مجلس الشورى رقم 76/61 وبتاريخ 27/12/1425هـ )6/2/2005م(تعديل المادة الأولى من لائحة دور الملاحظة الاجتماعية؛ لرفع سن القبول إلى اثنتي عشرة سنة بدلاً من سبع سنوات٬ ٬ والتي صدرت بقرار مجلس الوزراء ذي الرقم 611 وبتاريخ 13/5/1395هـ )23/5/1975م(٬ لتصبح كما في النص الآتي: "تهدف دور الملاحظة الاجتماعية إلى رعاية الأحداث الذين لا تقل أعمارهم عن اثنتي عشرة سنة ولا تزيد على ثماني عشرة سنة٬ عدا ما يقرره القاضي أو ما تراه جهة التحقيق من المصلحة في التحفظ على الأحداث في دور الملاحظة الاجتماعية". كما يؤكد القرار على "إجراء دراسة من قبل جهة متخصصة عن جنوح الأحداث٬ وتقويم الإجراءات المتبعة بشأنهم٬ وكذلك البرامج و جوانب الرعاية التي تقدم لهم في المؤسسات والدور المخصصة لرعايتهم٬ ووضع خطة شاملة تتناول الجوانب الوقائية والعلاجية٬ وتشتمل على تحديد برامج الرعاية والإصلاح وإعادة الاندماج في المجتمع٬ وآليات تنفيذها٬ ودور الجهات ذات العلاقة في التعامل مع الأحداث المعرضين للانحراف والجانحين من الذكور والإناث".
164. وفي السياق نفسه يأتي قرار مجلس الشورى 67/49 وبتاريخ 2/11/1426هـ )3/12/2005م(٬ كما سيأتي تفصيله لاحقا في )الفقرة 306( بشأن الأحداث مجهولي الهوية المودعين بدور الملاحظة الاجتماعية.
165. الموافقة على إجراء بعض التعديلات المتعلقة بقضايا الأحداث٬ وكيفية التعامل معها٬ بالقرار رقم 84/57 وتاريخ 20/11/1427هـ )10/12/2006م(٬ المتضمّن الموافقة على مشروع الإجراءات المتعلقة بقضايا الأحداث والفتيات٬ عند الحاجة لإيقافهم في مناطق ليس فيها دور للملاحظة الاجتماعية ٬ أو مؤسسات لرعاية الفتيات٬ ومن أهم ما ورد فيه: "إذا وجه القاضي أثناء المحاكمة بإيقاف الحدث أو الفتاة٬ فيجب على رئيس جهة الضبط الجنائي ترحيل الحدث أو الفتاة فوراً إلى دار الملاحظة الاجتماعية٬ أو مؤسسة رعاية الفتيات٬ إذا رؤي أن المصلحة تقتضي ذلك٬ وفي جميع الحالات التي تستدعي ترحيل الحدث أو الفتاة ٬ يجب أن يتم الترحيل بصحبة ولي أمر الحدث أو الفتاة )أو بصحبة مرافقة أمنية إن أمكن(٬ وبصحبة مندوب من هيئة الأمر بالمعروف والنهي عن المنكر٬ ويكون الترحيل بالطائرة إن وجد مطار قريب".
166. وقد تضافرت جهود وزارة الشؤون الاجتماعية ووزارة الداخلية في تطوير برامج الأحداث بالرعاية القضائية والتربوية والتقويمية عبر الآتي:
1 تغيير أهداف رعاية الأحداث في نزاع مع النظام أو المعرضين لذلك٬ من معاقبتهم ومحاسبتهم٬ إلى إصلاحهم٬ وتقويم سلوكهم٬ ومعالجة الصعوبات والعقبات التي يواجهونها. 2 تعديل اسم الدور التي ترعى الأحداث في نزاع مع النظام أو المعرضين للنزاع مع النظام من الجنسين إلى )دور الملاحظة الاجتماعية٬ و دور التوجيه الاجتماعي إضافة إلى مؤسسات رعاية الفتيات(. 3 أنشئت إدارة رعاية الأحداث٬ لتشرف على تلك الدور٬ وتعمل من أجل تحقيق أسس التوجيه والإصلاح والتقويم والتأهيل الاجتماعي للأحداث في نزاع مع النظام أو المعرضين للنزاع مع النظام من الجنسين. 4 فصل الأحداث عن الكبار في دور خاصة٬ نظراً للآثار السلبية المحتملة من إيداعهم في السجون جراء اختلاطهم بسجناء يكبرونهم سنا٬ً وبعضهم من أصحاب السوابق. 5 تنفيذ إجراءات التحقيق والمحاكمة داخل دار الملاحظة٬ وفي ظروف اجتماعية ونفسية ملائمة. 6 دراسة أسباب مشكلات الأحداث الجانحين٬ وإيجاد الحلول المناسبة لها٬ وتركيز الدور في خططها على الجانب العلاجي عبر البرامج الهادفة والنشاطات الموجهة المتنوعة لمقابلة احتياجاتهم ٬ وتفهم مشكلاتهم٬ ودراسة سوء توافقهم٬ وتشخيص مشكلاتهم السلوكية بغية تقديم العون والمساندة والرعاية لهم وتعديل بعض المفاهيم الخاطئة٬ وتمكينهم من العودة إلى المجتمع متوافقين اجتماعيا٬ً ونفسيا٬ً ونافعين لأنفسهم٬ وأسرهم٬ومجتمعه. • دور التوجيه الاجتماعي: 167. تعنى هذه المؤسسات بتحقيق أسس التربية والإصلاح والتأهيل لفئات الأحداث الذين يواجهون صعوبات مع النظام٬ أو أسرهم٬ أو المشردين نتيجة لأوضاع أسرهم ممن تتراوح أعمارهم بين سبع سنوات ولا تتجاوز ثماني عشرة سنة٬ ويتم عزل هؤلاء الأحداث عن العوامل النشطة التي قد تكون سبباً رئيساً في خلق النزاعات والصعوبات. وتعتمد هذه الدور على مجموعة من التدابير والبرامج الوقائية والعلاجية وتوفير المناخ والبيئة المناسبة للأحداث؛ بهدف
وتوجيه سلوكهم وتأهيلهم للتكيف مع المجتمع٬ فضلاً عن توفير التعليم الابتدائي والمتوسط بمدارس الدار. وللحصول على خدمات تلك الدور يتقدم ولي أمر الحدث بطلب إلحاقه بالدار وفق الإجراءات النظامية ومسوغات القبول والتي

161. Within the framework of the KSA’s care over the Periodic Review of the conditions of juveniles in social institutions [in care] and in accordance with Article 25, the state has taken a number of measures in order to guarantee the rights of children placed in care or protection, or whose physical or mental health is being looked after by the competent authorities, through a periodic review of care provided to children and all other conditions of children’s placement in care, in addition to that which will be detailed during discussions regarding the juvenile justice system. These measures include the following:
162. The Council of the Ministers’ publication of resolution no. 169 dated 19/06/1429 (23 June 2008), on the organised regulations for placing juveniles in Social Monitoring Homes. These regulations, which are detailed in paragraph 320, concentrate on [juvenile] treatment, rehabilitation, and reintegration into society in a manner inspired by the general provisions of the Convention on the Rights of the Child. Likewise, several governmental entities are examining the juvenile welfare system with a view to improve it and address shortcomings in the current system. The project also includes setting up courts for juvenile [offenders]. In addition, the National Committee for Childhood has examined and reviewed the draft of this proposed law/code, and has made appropriate amendments in accordance with the Convention on the Rights of the Child and the observations made by the CRC on the KSA’s Second Report. These entities have provided the Convention and the CRC’s comments which relate to juveniles so they may be taken into account during the drafting of the final version of this law/code.
163. The Council of the Ministers’ publication of resolution no. 61/76 dated 27/12/1425 (6 Feb 2005), [which includes] the amendment of the first article from the list of [concerning?] Houses of Social Observation, to increase the age of admittance to 12 years rather than 7. This was decided by the Council of the Ministers resolution no. 611, dated 13/05/1395 (23 May 1975), and became [was amended] thus: “Houses of Social Observation aim to care for juveniles between the ages of 12-18, unless the judge rules otherwise or the prosecution deems it to be in [whose? unclear] interest to detain juveniles in Houses of Social Observation”. The resolution goes on to confirm the decision that “experts [should] conduct a study on juvenile delinquency, and assess the steps taken to follow juvenile issues, programmes, and aspects of juvenile care they receive from institutions and specialised care homes, to form a comprehensive plan to deal with preventative and remedial measures, which includes specifying programmes for care, rehabilitation, and reintegration into society, mechanisms for their implementation, and the role of authorities who deal with collaborating with juveniles who vulnerable/exposed to perversion [note: unsure about this—wording is unclear and could mean vulnerable to abuse or youths at high risk of themselves becoming offenders], and male and female delinquents.
164. Within the same context comes the Shura Council’s resolution no. 67/49 dated 2/11/1426 (3 Dec 2005), as detailed in paragraph 306, on the matter of unidentified juveniles [who] are placed in Houses of Social Observation.
165. The agreement to make some amendments related to juvenile cases and how to process them, [encapsulated by] resolution no. 84/57 dated 20/11/1427 (10 Dec 2006), which includes an agreement male and female juvenile cases, and when it is necessary to detain them in areas that do not have Houses of Social Observation, or care homes for young boys and girls. The most important element of this states:
"If the judge stipulates during the trial that a juvenile (boy or girl) be detained, the head of the criminal investigation authority must immediately transfer the juvenile instantly to a House of Social Observation, or a care home for girls, if this is deemed [by the judge] to be in the interest [of the investigation]. In all cases that require the detention of juveniles in custody, they must be transferred accompanied by a guardian (or a security accompaniment if possible), and by a delegate from the Committee for Commanding the Good and Forbidding Evil, and should be transferred by plane if there is an airport nearby.”
166. The Ministries of Social Affairs and the Interior have combined efforts to develop juvenile programmes of judicial and educational care through the following list:
1 – Changing the aims of care for juveniles in conflict with the law or vulnerable to it [young offenders], from [how they are] punished and held to account, to their reform, correcting their behaviour, and addressing the challenges and obstacles they face.
2 – Changing the name of the institutions that care for young male and female offenders (Houses of Social Observation, Houses of Social Guidance, and Care Homes for Girls),
3 – The management of juvenile care was set up to supervise these homes, and to realise a base of guidance, reform, correction, and social rehabilitation for juveniles of both sexes who are in conflict with the law.
4 – The separation of juveniles from adults in special institutions, in view of the potential negative effects of detaining them in prisons and mixing them with prisoners older than them, some of whom have [legal] precedents [are repeat offenders].
5 – Carrying out investigations and trials within Houses of Observation, and under appropriate social and psychological conditions.
6 – Studying the causes of juvenile offenders’ problems and finding appropriate solutions for them; focusing on institutions’ plans for their treatment through programmes and diverse guided activities to meet their needs, understand their problems, study their disagreements, and diagnose their behavioural problems in order to offer them aid, support, and care, and to amend their misconceptions, and to enable them to return into society [in a manner that is] socially and psychologically harmonious, [so that they may be of] benefit to themselves, their families, and their community.
Houses of Social Guidance
167. These institutions are concerned with realising the fundamentals of education, rehabilitation, and qualifying classes of juveniles who face difficulties with the law or their families, or are displaced [??] as a result of their family situation, and whose ages are between 7 and 18 years old. These juveniles are isolated from the active elements [??], which can be a primary reason for conflict and disagreement. These institutions [of care] rely on a set of preventative and remedial measures and programmes, and provide an environment and atmosphere appropriate for youths, with the aim of guiding their behaviour and rehabilitating them [so they may] adapt to society, as well as providing them with primary and middle school education in the homes’ schools. In order to obtain services of these homes, the guardian applies for the juvenile to be admitted in the institution in accordance with the legal procedures and acceptance criteria, which include comprehensive social, psychological, and medical studies, on which basis the suitability of alternative solutions, or, in the last resort, enrolling the juvenile in the institution, is decided. Houses of Social Guidance were set up in Ryadh, Medina, Dammam, Buraydah, and Taif and tables 25-31 include the number of beneficiaries in the Houses of Social Guidance according to [grouped by] the reason for their detention, age group, duration of stay, reason for folding [closing?] their case, and their educational status during the two years 1430-1431 (2009-2010).
168. Houses of Social Observation are governmental institutions specialised in presenting direction, guidance, health, and educational care for juveniles who commit crimes, or who are taken into custody while under investigation, or individuals between the ages of 12-18 caught by the security authorities for committing crimes which require their rehabilitation and the return of rights [stolen goods?] to their owners. However, due to their youth, they are regarded as juvenile offenders who, due to environmental, social or psychological conditions, need help and treatment. Juveniles remain in the House of Observation for the period the judge stipulates, depending on what he views as sufficient for treatment and in light of the results of the social research. Efforts are intensified during the juvenile’s stay in the institution to correct, cure, and rehabilitate through educational programmes for students, including those of primary, middle, or secondary school level. The educational apparatus undertakes this through the Ministry of Education. Likewise, non-students are given the opportunity to enrol in professional courses which help them develop their interests and occupy their free time, and allow them to gain [vocational] manual, professional, and artistic experience. In addition, institutions provide social, artistic, and sports programmes. In accordance with this view, the Ministry of Social Affairs has set up 14 Houses of Social Observation in a number of cities in the KSA, included in a table (32-37) are the number of beneficiaries enrolled in Houses of Social Observation, grouped by reason for detention, age group, duration of stay, reason for case folding [concluding?], and educational status from 1430-31 (2009-10).

317. ونظراً لتشابه وتقاطع ملحوظات وتوصيات اللجنة الدولية المذكورة هنا مع تلك التي تم معالجتها في صدد ملحوظات وتوصيات اللجنة حيال المراجعة الدورية لإيداع الطفل في المؤسسات )فقرات رقم 256247( ٬ فيرجى الرجوع إلى ما تم تفصيله سابقاً؛ لبيان ما تم اتخاذه من إجراءات وما تبذله المملكة من جهود لتوائم أنظمتها مع مقتضيات المواد 37 ٬ 40 و 39 من الاتفاقية٬ وكذلك المقاييس والمبادئ القواعد النموذجية الدولية الخاصة بالأطفال والأحداث في نظام العدالة الجنائية. 318. وبالإضافة لما تم ذكره في تناول المادة 25 من الاتفاقية في هذا التقرير٬ وتأكيداً لما سبق تفصيله في تقرير المملكة الثاني بشأن نظام الإجراءات الجزائية الصادر بالمرسوم الملكي م/2 بتاريخ 28/7/1435هـ٬ والمتضمن منع التعذيب أو المعاملة المهينة في أي مكان٬ فإن الأنظمة المُطبقة بالمملكة العربية السعودية تميز وبوضوح بين المسؤولية الجنائية للأطفال والمسؤولية الجنائية للكبار٬ حيث إن النظام الخاص بقضاء الأحداث خصص محاكم خاصة بإشراف قضاة مختصين لمحاكمة الأطفال تقوم على أساس التفريق الواضح بين الأطفال والكبار٬ وذلك وفق ما جاء في قرار مجلس القضاء الأعلى في دورته الخامسة والستين رقم 239/95 وتاريخ 29/6/1428هـ )15/7/2007م( بشأن تكليف "قضاة المحكمة الجزائية للنظر في قضايا الأحداث وقضايا دار الملاحظة لمدة أربعة أشهر ولكامل الأسبوع على أن يشمل التكليف جميع قضاة المحكمة ماعدا من يعمل في المحكمة بالندب ونحوه( بل إن القاضي هو الذي يذهب لمقر الحدث ولا يجلب الحدث المتهم للمحكمة. وتعمل هيئة التحقيق والإدعاء العام على متابعة وتقصي ظروف الأحداث ومراعاة الحقوق الإنسانية في تطبيق الإجراءات العقابية المختلفة٬ حيث لا يجوز معاقبة الأحداث بأي نظام سوى الأنظمة الخاصة بهم والمطبقة عليهم٬ والادعاء عليهم يكون من قبل هيئة التحقيق والادعاء العام وفق تعميم هيئة التحقيق والادعاء العام رقم هــ 11/8795 وتاريخ 2/4/1430هـ )29/3/2009م(.
319. كما أن محاكمة الاحداث تتطلب اتخاذ كل التدابير الإصلاحية المتاحة٬ وأن تقتصر الحلول على المعالجة والتأهيل وإعادة دمجهم في المجتمع على نحو يستلهم التوجهات العامة من اتفاقية حقوق الطفل. ويشترط النظام نصا على أن تكون محاكمة الاحداث سرية ولا تتم إلا بوجود الاختصاصي الاجتماعي. ورغ َّب النظام في سرعة البت في محاكمة الأحداث دون إيداعهم في دور الملاحظة الاجتماعية٬ وتقليل مدة الحكم بالتحفظ عليه عند الضرورة القصوى وإلى أقصر مدة ممكنة٬ مع تشجيع النُظم المعمول بها في السعودية على العفو عن العقوبة وتمكين القاضي من تقصير مدة بقاء الحدث في دار الملاحظة٬ وإمكانية إسقاط ما يقارب نصف المدة عنه عند تحسن سلوكه٬ فضلا عن الاستفادة من العفو الملكي العام الذي يصدر سنوياً قبل عيد الفطر بحيث يتمكن اليافع من قضاء العيد مع أسرته.
320. وانسجاماً مع توصية اللجنة الدولية بشأن تعديل نظم الحجز والسجن ونظام عدالة الأحداث ومنع العقوبة الجسدية ضد الأشخاص دون سن 18 عاماً المحرومين من حرياتهم٬ وكمتابعة لتطبيق الأنظمة وما قد يعتريها من نقص٬ تأتي التعليمات والضوابط تباعاً لسد النقص الذي يحدث في الأنظمة ولتغطية جوانب القصور ولمواكبة التطورات لذا صدرت ضوابط وتعاميم تتعلق بالأحداث ومحاكمتهم ومسؤوليتهم الجنائية والمدنية حيث صدرت الضوابط المنظمة لإيداع الأحداث في دور الملاحظة الاجتماعية بموجب قرار مجلس الوزراء رقم 169 في 19/6/1429هـ )24/6/2008م( ومن أبرز ما جاء فيها ما يلي :
1 إيداع الأحداث في دور الملاحظة الاجتماعية يقتصر على الذين يرتكبون أفعالاً معاقباً عليها ممن أتموا سن )12( ولم يتجاوزوا )18(.
2 يسلم الأحداث الذين يرتكبون أفعالاً معاقباً عليها وهم دون سن )12( إلى أولياء أمورهم بعد أخذ التعهّد عليهم بمتابعة قضاياهم حتى انتهائها٬ أو صدور أحكام فيها وتنفيذها٬ فإن رأت جهة التحقيق أن مصلحة الحدث أو مصلحة التحقيق تقتضي أن يتحفظ عليه فيكون ذلك في دور التوجيه الاجتماعي٬ فإن تعذر ذلك يخير ولي أمر الحدث في إيداعه إلى أقرب دار توجيه اجتماعي أو التحفظ عليه في دار الملاحظة الاجتماعية في المدينة أو المحافظة التي يقيم فيها أو في أقرب درا ملاحظة اجتماعية لهما. 3 يودع الأحداث الذين يرتكبون إحدى الجرائم الكبيرة أو تصدر بحقهم أحكام بالسجن في تلك الجرائم وهم دون سن )12( في دور الملاحظة الاجتماعية حتى انتهاء مدة توقيفهم أو تنفيذ محكوميتهم.
4 التأكيد على جهة التحقيق بالعمل على حلّ جميع قضايا الأحداث بشكل عام٬ ومن هم دون سن )12( بشكل خاص٬ وإنهاءها دون إحالة الأحداث إلى دور الملاحظة الاجتماعية٬ وفقاً لما قضى به قرار مجلس الوزراء رقم )25( وتاريخ 26/1/1421هـ وتعديلاته.
5 على الجهة التي تتولى الإدعاء في قضايا الأحداث )وبشكل خاص من لم يتم سن 12( أن تطلب من القضاء النظر في الحكم بعقوبات أخرى بديلة عن السجن.
6 ترفع وزارة الشؤون الاجتماعية إلى المقام السامي )بعد خمس سنوات من تنفيذ هذه الضوابط( تقريراً شاملاً ومفصلاً عن المزايا المتحققة والصعوبات التي واجهتها٬ والمقترحات التي تراها لمعالجة ذلك.
321. وتقوم الأجهزة التشريعية في المملكة حالياً باستكمال مشروع نظام العقوبات البديلة الذي يتضمن معالجة تشريعية شاملة من شأنها إنسجام نظام عدالة الأحداث بشكل خاص وكذلك العقوبات بشكل عام مع توصية اللجنة الدولية بشأن العقوبات البديلة. هذا فضلا عن ما تقوم به الجهات التعليمية والاعلامية والقضائية بجهود مستمرة في
منع العقوبات الجسدية بما في ذلك مؤسسات الدولة كالشرطة٬ والسجن٬ وكذلك الأسرة والمدرسة. كما تقوم عدة
جهات حكومية بتدارس نظام رعاية الاحداث بغية تجويده ومعالجة جوانب القصور في النظام المعمول به الأن٬ كما يتضمن المشروع إنشاء محاكم للأحداث. هذا وقد قامت اللجنة الوطنية بالطفولة بدراسة ومراجعة مسودة هذا النظام المقترح٬ وإجراء التعديلات المناسبة وفق اتفاقية حقوق الطفل وملحوظات اللجنة الدولية على تقرير المملكة الثاني٬ وتزويد هذه الجهات بالاتفاقية وملحوظات اللجنة الدولية ذات العلاقة بالاحداث لأخذها في الحسبان اثناء صياغة المسودة النهائية لهذا النظام.
322. وفي سياق مناقشة مواصلة الجهود في المملكة للرفع من عدد المحاكم الخاصة بالأحداث ومن كفاءة القضاة والمحامين وضباط الشرطة وممثلي النيابة المختصين٬ وتأمين تدريب المهنيين في المجال٬ وتدريب المختصين في مجال إعادة التأهيل والاندماج الاجتماعي للأطفال في نزاع مع النظام وعلى الأخص أولئك المحرومين من حريتهم.
نذكّر بما سبق الإشارة إليه من أن مشروع الملك عبدالله لتطوير القضاء و نظامي القضاء وديوان المظالم وآليتهما التنفيذية المعتمدان بالمرسوم الملكي رقم م/78 في 19/9 /1428هـ ٬ بغية إعادة هيكلة مؤسسات القضاء لتؤدي واجباتها بفعالية٬ وتضمّن النظام تشكيل محاكم جديدة٬ وتطوير صلاحيات واختصاصات المجلس الأعلى للقضاء٬ وإنشاء المحكمة العليا٬ وإنشاء محاكم الاستئناف٬ وتطوير محاكم الدرجة الأولى مثل المحاكم الجزائية. وتتضمن المحاكم الجزائية إنشاء دوائر لقضايا الأحداث حيث تتشكل كل دائرة من ثلاثة قضاة وهذا يعتبر تطور مهم نحو تحقيق ضمانات المحاكمة العادلة حيث كانت المملكة تعتمد قبل صدور هذا النظام على نظام القضاء الفردي في قضايا الأحداث.

316. We would like to indicate the CRC’s comments in its report published following the consideration of the Second Periodic Report on the KSA, which commend the efforts the KSA has made to reform the juvenile justice system, in adopting a new system of criminal procedure, a professional code of conduct for the legal sector, the KSA’s creation of special courts for minors, [the KSA’s placement of] children under the age of 18 in separate detention centres, and [the fact that] minors have the right to legal representation.
317. In view of the similarities and overlap between the observations and recommendations of the CRC here with those that were addressed during the periodic review of the placement of children in institutions (care) (paragraphs 247-256), please see the above sections to see what steps were taken and what efforts the KSA made to align regulations with the requirements of Articles 37, 40, and 39 of the Convention, and likewise the international standards and fundamental guiding principles concerning children and minors in the criminal justice system.
318. In addition to what has been mentioned with regards to Article 25 of the Convention in this report, confirming as previously detailed in the KSA’s Second Report on the Criminal Justice System issued by royal decree (m/2?) dated 28/7/1435, which contains a ban on torture or degrading treatment anywhere, the applicable regulations in KSA make a clear distinction between criminal liability for children and adults. The special system for minors allocates special courts, which are based on the clear distinction between children and adults, under the supervision of judges specialised in children’s trials. This is in accordance with the decision reached by the High Council of Judges in its 65th session, no. 95/239 on 29/6/1428 (15 July 2007), which concerns assigning judges to consider the cases of juvenile cases and Houses of Observation [detention centres?] full-time over a period of four months. This involves assigning all judges of the court [this project], except those who work in the court as delegates and the like. The judge is the one who goes to the juvenile residence rather than summoning accused minors to court. The Committee for Investigations and Public Prosecutions works on following and tracking the conditions of juveniles and observing human rights in the implementation of different punitive measures. Minors may not be sentenced through any system other than special systems [created] for and applicable to them. Allegations against minors are [made by] the Committee for Investigations and Public Prosecutions in accordance with the Committee’s Circular no. 8795/11, dated 2/4/1430 (29 March 2009).
319. Likewise, the Juvenile Court requires all the available reform measures be taken, and that solutions be limited to curing, rehabilitating, and reintegrating minors into society in a way inspired by the general outlook of the Convention on the Rights of the Child. The letter of the system requires Juvenile Courts to be confidential, and this will not be [possible] unless there is a social specialist. The system wishes for decisions to be reached with greater speed in the Juvenile Court, without placing them in Homes of Social Observation, and to decrease the period of sentences and custody when absolutely necessary and for the shortest amount of time possible, and to encourage the systems in place in KSA to grant amnesty and allow judges to shorten the period during which minors remain in Houses of Observation, and allow judges the possibility of shortening nearly half the sentence when a minor’s behaviour improves, in addition to making use of the King’s general amnesty, which is granted every year before Eid al-Fitr and allows young [offenders] to spend the day with their families.
320. In response to recommendations given by the CRC with regards to reforming the Prisons and Detentions Systems and the Juvenile Justice System, and regarding the ban on corporal punishment for under 18s deprived of their freedom, and to follow up on the application of systems and [their] possible deficiencies, there are instructions and controls, respectively, to deal with the shortcomings, and to keep up with developments if the controls and instructions issued are related to juveniles, their courts, their criminal liability, and the city where the controls for the juvenile care organisations were issued in Homes of Social Observation in accordance with the decision of the Council of Ministers no. 169 on 19/6/1429 (24 June 2008), of which the most prominent were:
1 – Juvenile care in Homes of Social Observation is limited to juveniles who commit crimes between the ages of 12 and 18.
2 – Juveniles who have committed crimes and are under the age of 12 are delivered to their parents after they [unsure who “they” refers to here—the parents or the institutions/judges?] have pledged to follow their case to the end [of the investigation?], or until a verdict is issued and implemented. If the view of the investigation is that it is in the interest of the juvenile, or if the investigation requires that the juvenile be looked after [held in custody], then it is the Homes of Social Rehabilitation that do so. Failing that, the juvenile’s guardian would choose between custody in the nearest Social Rehabilitation Home, or a Social Observation Home in the city or province where he resides, or the nearest one to them [his parents? – dual].
3 – Juveniles who have committed serious crimes or have been issued prison sentences for serious crimes and those under 12 years of age are placed in Social Observation Homes until their period of arrest expires or until their sentence is applied.
4 – Emphasis of the investigation’s view on the work towards resolving all juvenile cases in general, and in particular those under the age of 12, and concluding them without transferring juveniles to Homes of Social Observation in accordance with the decision of the Council of Ministers no. 25 dated 26/1/1421, and its amendments.
5 – For the party responsible for prosecutions in juvenile cases (and in particular for under 12s), judges are requested to consider [giving] verdicts with sanctions other than imprisonment.
6 – The Ministry of Social Affairs would like to bring to the foremost attention (five years after the implementation of these regulations), a comprehensive and detailed report on the benefits and challenges it has faced, and advice it sees for addressing that [these].
321. The legal mechanisms in the KSA are currently completing a programme to organise alternative punishments, which include comprehensive legal treatment on harmonising the juvenile justice system in particular, and likewise sentencing in general, with the recommendations of the CRC on alternative sentencing. This is addition to the continuous efforts made by educational, media, and judicial stakeholders to ban [end?] corporal punishment, including that [inflicted by] state institutions such as the police and prisons, as well as families and schools. Likewise, a number of governmental stakeholders have undertaken to examine the system of juvenile welfare with a view to improving it and addressing the shortcomings of the current system. The project also includes setting up juvenile courts of law. Furthermore, the National Committee for Childhood has undertaken a study and draft review of this recommended system, and to implement the appropriate amendments in accordance with the Convention on the Rights of the Child and the CRC’s recommendations in the Second Report on the KSA, and to provide these parties to the Convention related to juveniles to take them into account while formulating the final draft of this law.
322. Within the context of the continuing discussion are the KSA’s efforts to increase the number of special courts for juveniles, the competence/capacity of judges, lawyers, police officers, and specialist prosecutors, and to ensure trainings for professionals in the sector and for specialists in youth rehabilitation and social integration [who are] in conflict with the law, and particularly those deprived of their freedom. We would like to reiterate what was previously indicated regarding King Abdullah’s project for the development of the judiciary, the judicial systems/laws, the Office of the Ombudsman and their executive mechanisms, which rest on Royal Decree no. m/78 dated 19/9/1428, which aims to restructure judicial institutions such that they may fulfil their functions effectively. The law includes [stipulations for] the formation of new courts, the development of the terms of reference/authority and capacities of the High Council of Judges, setting up a High Court and courts of appeal, as well as developing courts of first instance like the criminal courts. The criminal court [reforms] include setting up departments for juvenile cases, whereby each department is made up of three judges. This is considered an important development towards the realisation of assurances of fair trials, for which the KSA, prior to this law, relied on [the discretion of?] individual judges in ruling on juvenile cases.
